Please read these Terms of Service carefully before using the website at https://mindtrektechnologies.com/ or any MindTrek Technologies application distributed through the Shopify, Wix, or Shopline app stores, including MindTrek: Countdown Timer.
Throughout this document, the terms "we," "us," "our," and "the Company" refer to MindTrek Technologies. The terms "you," "your," and "user" refer to any individual or business that accesses or uses our website and/or our Shopify, Wix, or Shopline applications, and who has agreed to be bound by the Company's terms.
1.1 Browsing our website, installing our apps, or purchasing any product or plan from us constitutes your use of the "Service." Continued access to the Service depends on your acceptance of, and adherence to, these Terms.
1.2 These Terms govern every visitor, customer, merchant, or other party who uses the Service in any capacity.
1.3 By using the Service, you confirm that you accept these Terms in full. If any part of these Terms is unacceptable to you, you must discontinue use of the Service.
2.1 MindTrek Technologies will never request your card or payment information directly. All recurring subscriptions and one-time charges for our Shopify, Wix, and Shopline applications are processed solely through the billing systems of the respective platform (Shopify, Wix, or Shopline).
2.2 Should you have any doubt about the legitimacy of a payment request, please reach out to us at support@mindtrektechnologies.com before proceeding. Because MindTrek Technologies never handles or stores your payment details directly, we cannot be held responsible for losses resulting from fraudulent or phishing schemes impersonating us.
2.3 All sales are final; MindTrek Technologies does not issue refunds.
2.4 We may revise pricing, subscription tiers, billing periods, or included features at any time, and such revisions may apply immediately to both new and existing users without advance notice. MindTrek Technologies bears no responsibility for any inconvenience or loss arising from these adjustments.
MindTrek Technologies reserves the right, at its sole discretion, to:
3.1 Alter, suspend, or discontinue the Service, or any portion of it, at any time and without prior notice; you agree that we will not be held liable to you for any resulting changes or discontinuation.
3.2 Amend these Terms at any time.
3.3 Adjust pricing for the Service without advance notice; continuing to use the Service after such an adjustment will be treated as your acceptance of the new pricing.
3.4 Modify, restrict, expand, or discontinue any subscription plan, pricing structure, feature set, usage limit, or availability of our Shopify, Wix, or Shopline applications at any time, without prior notice. Your continued use of the Service after any such change constitutes your acceptance of the revised plans and terms of use.
4.1 The Service may reference, link to, or integrate with software and services operated by parties other than MindTrek Technologies ("Third Parties").
4.2 Referencing or integrating with a Third Party does not constitute our endorsement of that Third Party.
4.3 You acknowledge that MindTrek Technologies has no control over, and accepts no responsibility for, the content, performance, or availability of any Third-Party service.
5.1 All intellectual property associated with MindTrek Technologies and the Service — including but not limited to its design, written content, graphics, software, and underlying source code — is either owned by MindTrek Technologies or used by us under a valid license or other legal permission.
5.2 By using the Service, you agree that your access is limited to personal or internal business use only. No part of the Service's content may be downloaded, copied, reproduced, republished, stored, sold, or otherwise distributed without MindTrek Technologies' prior written permission.
6.1 You use the Service entirely at your own risk. The Service is furnished on an "as is" and "as available" basis, with no warranties — express or implied — including any implied warranty of merchantable quality, fitness for a particular purpose, non-infringement, compatibility, security, or accuracy.
6.2 To the fullest extent the law allows, MindTrek Technologies will not be liable for any indirect, incidental, or consequential loss (including, without limitation, lost business, lost opportunity, lost data, or lost profit) connected with your use of the Service.
6.3 MindTrek Technologies does not guarantee that the Service will run without interruption or error, that any faults will be fixed, or that the Service or its hosting infrastructure is free of viruses or other harmful components.
7.1 Any obligations or liabilities that arose before termination will continue to apply even after this agreement ends.
7.2 These Terms remain in effect until terminated by either party. You may end this agreement at any time by informing us that you no longer wish to use the Service, or simply by discontinuing use of our website and applications.
7.3 If we determine, or reasonably suspect, that you have violated any part of these Terms, we may terminate this agreement immediately and without notice. You will remain responsible for any amounts owed through the termination date, and we may restrict or revoke your access to some or all of the Service.
You agree to defend, indemnify, and hold harmless MindTrek Technologies, along with its staff and representatives, from any claims, liabilities, legal costs, damages, or other expenses arising from your violation of these Terms or from any other consequence of your use of the Service.
If any provision of these Terms is found by a competent court to be invalid, unlawful, or unenforceable, that provision will be removed, while the remaining provisions will continue to apply in full force.
Our failure to act on a violation of these Terms on any occasion does not prevent us from enforcing our rights should a similar or other violation occur in the future.
These Terms are governed by the laws of India. You agree that any dispute, claim, or legal action related to your use of the MindTrek Technologies website or its Shopify, Wix, or Shopline applications will fall under the exclusive jurisdiction of the courts of Rajkot, Gujarat, India.
